Welcome to It’s all Irish

This document and the other documents that we reference below make up our Terms of Use.

By visiting our site and or purchasing something from our website, you engage in our “service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and or available by hyperlink. These Terms of Service apply to all users of the website, including without limitations users who are browsers, vendors, customers, merchants and content contributors.

The website (“the “service”) is operated by It’s all Irish, registered in Co. Kildare, Republic of Ireland under the company number 675057 (“we”, “our”, or “us”)

 

Your Relationship With Us

  1. This document and any documents referred to within it (collectively, the “Terms of Service”) set out the terms of your relationship with us. It is important that you read and understand the Terms of Service before using the service. If there is anything within them that you do not understand, please contact us at support@itsallirish.ie to discuss your query.
  2. By setting up an account with It’s all Irish and/or using or accessing the Service, you agree to and accept these Terms of Service in their entirety. If you do not agree to these Terms of Service, you must not use the Service.

 

Information About You and Your Privacy

You privacy and personal security is of utmost importance to us. You should read our Privacy Policy to understand how we collect, use and share your information about you. You should also read our Cookies Policy to understand how we use cookies within the service.

 

Setting Up An Account

  1. To access our Service, you must register with us and set up an account with a username and password (your “account”). We encourage you to use a strong password with a combination of upper and lower case letters, numbers and symbols.
  2. You must be at least 18 years of age to enter a legally binding agreement with It’s all Irish. It’s all Irish does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for the Service. It’s all Irish is a general audience site. Minors under the age of 18 are prohibited from providing any personal information to the website. In the event that we learn that we have collected personal information from a minor under the age of 18 without parental consent, we will delete that information as quickly as possible.
  3. You are responsible for maintaining the confidentiality of your login details and any activities that occur under your account. If you have any concerns that your Account may have been misused, you should contact us immediately at Support@itsallirish.ie and let us know.

 

 

It’s All Irish Payments

  1. Our Service allows you to advertise, buy and sell items from Irish made businesses.
  2. You can sell your items/ advertise your business through our Service by publishing pictures, videos and/ or description of the product/ service you want to sell. When a Service user purchases such Sale Item, this is a “Sale Transaction”.
  3. Sale Transactions are managed via Stripe. Vendors will need a Stripe account to receive payments. For a detailed breakdown of Stripe charges please visit Pricing & fees | Stripe | Ireland.
  4. We want our Service to be a positive experience for our users and we ask that you honour the commitments you make to another user in respect of the sale or purchase of any Sale Item.
  5. It’s all Irish strictly verifies each vendor and service that registers with us. As we are not the seller of any Sale Items, we have no control and do not give any commitment to the accuracy of description of Sale Items. Sellers are responsible for ensuring age restricted items are marked clearly with the acceptable age restriction (as required by law) and Buyers agree that they shall not attempt to purchase Sale Items if they are younger than the advertised legal age restriction.
  6. The vendor shall be responsible for their own VAT charges, payments and all matters associated with VAT and the sale of goods act - Sale of Goods Act, 1893 (irishstatutebook.ie)
  7. We monitor our website very closely for any fraudulent behaviour. If you find a shop on It’s all Irish that you think may be misleading, please contact us at Leanne@itsallirish.ie.
  8. Funds from sales will be released twice a month – the 14th and 28th of each month. Its all Irish will release funds after the 14 day period to ensure that we maintain consumer safety with regards to return of any items.

 

Your Right To Use The Service

You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content presented to you through the Service is protected by copyrights, trademarks, service marks, patents and other proprietary rights and laws. Except as expressly authorized by us or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or Content, in whole or in part.

These Terms of Service do not grant you any rights to, or in, any such intellectual property rights or any other rights or licences in respect of It’s all Irish materials and content, the Service, It’s all Irish name and/ or trademarks, other than as set out in these Terms of Service.

You agree not to access, or make attempt to access the Service by any means other than through the interface that is provided by us for use in accessing the Service.

 

Your Content

  1. All products as a Sale Item must be produced/ designed on the Island of Ireland.
  2. All businesses registering with our Service must be registered within Ireland.
  3. You confirm that images, sounds, texts or information that you submit or create (“User Content”) whist using the Service will meet the Rules of Acceptable Use.
  4. You grant us worldwide, no exclusive, royalty free, irrevocable and perpetual licence to use copy, reproduce, distribute, adapt, re-format, modify, publish, translate, licence, sub-licence, assign, transfer and exploit the User Content (including intellectual proprietary right therein) anywhere and in any form for the purpose of providing our Service or for any purpose in connection with the operation of our business.
  5. Our right to use your User Content does not in any way affect your privacy rights and we will only use information that identifies you as set out in our Privacy Policy.
  6. We check but we do not moderate any User Content before it is added to the Service by Users. We may later check, moderate, refuse, reject or delete any User Content if we think it breaks the Rules of Acceptable Use, our we believe that it against our ethos of It’s all Irish.
  7. The General Date Protection Regulation (GDPR), under Article 15, gives individuals the right to request a copy of any of their personal data which are being “processed” by “controllers”, as well as other relevant information. Those requests are referred to “data subject requests” or “access requests”.

  9. Sale of Alcohol:
    1. Any member who wishes to sell alcohol must ensure that they have a valid license to do so. This includes but not limited to; a full off licence, a publicans licence, a wine retailers on licence or a wine retailers off license.
    2. All vendors must comply in full with all legislation controlling the sale of intoxicating liquor, to include but not limited to, the intoxicating Liquor Act 2008, Intoxicating Liquor Act 2003, Intoxicating Liquor Act 2000, the licensing Act 1872 together with any and all regulations regarding distance selling and the sale of alcohol online.
    3. The vendor must ensure that the transaction for the sale of alcohol takes place at the licenced premises.
    4. The vendor must show he/ she is in control of the delivery and that appropriate methods are used to ensure that the actual person who bought the alcohol takes delivery and must be over the age of 18. Failure to do so is a criminal offence.
    5. Delivery of alcohol is restricted to times when alcohol is permitted to be sold on the licenced premises.
    6. Failure to comply with the above provisions will result in the store being deactivated.
  10. All food vendors must uphold the requirements set out by Food Safety Authority of Ireland.

Rules of Acceptable Use

In addition to the other requirements within these Terms of Use, this section describes specific rules that apply to your use of the Service

  1. You must make sure the email address you provide in your account details remains active and is checked by you on a regular basis.
  2. You are responsible for all taxes relating to Sale Items through our service.
  3. To respond to your customers in a reasonable time frame (24hours)
  4. When using the Service you must not:
  • Create more than one account unless we agree otherwise
  • Give any false or misleading information in your account details
  • Permit another person to use the Service under your name unless authorized to do so.
  • Use the service if we have suspended or banned you from using it.
  • Send junk, spam or repetitive messages to other Users.
  • Engage in any illegal or unlawful conduct, and must comply with applicable legal requirements relating to the sale or purchase of Sale Items.
  • Modify, interfere, intercept, disrupt or hack the service.
  • Submit any User Content that contains unlawful content, nudity or violence, is abusive, bullying, threatening, harassing or untrue. We will suspend your account immediately without warning.
  • Unlawfully or unfairly interfere or manipulate any ratings system or user feedback system.
  • Submit or contribute any User Content without the permission of the content owner, or otherwise infringe the copyright, trademark or other rights of third parties.
  • Purchase or sell a Sale Item by making direct arrangements with the seller or the buyer.
  • Submit or contribute any information about another person without that persons permission, or post private confidential information via the Service.
  • No drop shipping allowed
  • Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Use and may result in our taking action, with or without notice (entirely at our discretion) including but not limited to, immediate withdrawal of your right to use our Service, issue a warning to you or legal action against you including proceedings for reimbursement of all costs resulting from the breach.
  • We may investigate any suspected breach of the Rules of Acceptable Use. During such an investigation we may temporarily withdraw your right to use our Service or remove your User Content without notice.

 

Subscription Service

Storefront

Our Storefront subscription service allows Vendors to create their online store, upload an unlimited amount of products, access to our community forum, paid advertising and advertising across all our social media platforms.

It’s all Irish does not charge any commission fee on sales which means the Vendor receives full payment (less stripe transaction fee).

Our monthly membership package is payable the same date that you subscribed with us. Payment will be automatically be deducted from the vendors account in which you used to register with us.

There are no hidden fees or charges within your membership. If you are unhappy with the service you can cancel your subscription at any time, free of charge.

 

Business Listing

Our Business Listing service allows business owners and service providers to list their business and advertise their services.

We will create an advertisement of your business including all your information (Logo, about us, your social media accounts) and you can link your own website to the advertisement.

Our monthly business listing package is payable the same date that you subscribed with us. Payment will be automatically be deducted from the business account in which you used to register with us.

You warrant that in using the online payment facility you are authorising It’s all Irish to use the debit or credit card for the payment or payments you are making. You are authorizing the deduction of the subscription cost amount from your credit/debit card on a recurring basis (monthly).

You agree that there will be available sufficient funds in the debit card account to make the recurring card payments when they fall due under the instalment terms. If a recurring card payment is declined It’s all Irish will make 3 subsequent attempts at collection before terminating your contract.

 

Ending Our Relationship

To opt out of any membership we ask all business owners to contact Support@itsallirish.ie and we can arrange same. Your store or business listing will remain live and active until the remainder of your subscription period, unless stated otherwise.

If you have outstanding orders after your monthly subscription ends, the vendor will still be able to access their store for 14 days after the subscription has ended to manage any outstanding orders or returns.

If such request comes from someone who is not the account holder, we may ask you to provide proof of request from User in question. Your store will remain open for the remainder of your subscription period unless otherwise requested to remove.

 

Our Responsibility to you

  1. You alone decide whether to proceed with a sale or purchase of a Sale Item. As such, we make no commitments regarding the Sale Items including the quality or delivery of the Sale Items, or for honouring (or causing any seller to honour) any inaccurate information regarding the price, description and availability of, or any information relating to any Sale Items promoted or available through our Service, or the ability of the buyer to complete any purchase of the Sale Item.
  2. Although it is our intention that the service is available as much as possible, there may be occasions when the Service may be interrupted, including for schedule maintenance, upgrades or emergency repairs, or due to failure of telecommunications links.
  3. You may be able to access third party links/ websites/ products/ services via the Service. It’s all Irish is not responsible or liable for any third party links/ websites/ product or services which may be access by you at your sole option. Your access to third party links is at your own risk and will be subject to your acceptance and compliance with the separate terms and conditions of third party.
  4. To the maximum extent permitted by the law, our total responsibility for any claims relating to a Sale Transaction is limited to the subscription
  5. For any other claims arising out of the provision of the Service (including without any limitation any dispute between users where this does not fall within paragraph 4 above, in relation to any content you access via the Service, or any other user you interact with), we do not accept responsibility whatsoever (whether arising in contract, tort otherwise), except where we cannot disclaim, exclude or limit responsibility by law (such as death and/ or personal injury caused by negligence).
  6. We will never be responsible for any loss or damage that is not reasonably foreseeable and we will never be responsible for the indirect losses and/ or financial and business loss, or loss of goodwill or reputation.

 

Your Responsibility To Us/ Indemnity

If It’s all Irish is sued due to an action or inaction (including breach of these Terms of Service) then we have the right, at our discretion, to request that you indemnify us (i.e. cover our costs and legal fees) and hold us harmless from any legal claim or demand for expenses or costs that arise as a result. Where we decide to conduct the defence of such claim, you agree to assist us as reasonably requested.

 

Resolving A Dispute With Us

If you have a dispute with us or our vendors relating to the Service, please contact us at dispute@itsallirish.ie and attempt to resolve the dispute informally first.

 

Disputes with other users relating to a Sale Transaction

  1. All purchase of Sale Items made outside of It’s all Irish are against our Terms of Service and are not covered by Buyer or Seller protection.
  2. Please know in regards to any kind of Buyer or Seller protection, we can only accept tracking codes as valid proof of delivery (a tracking code that can be verified online), and that the cost of returning the Sale Item cannot be refunded.
  3. Buyer or Seller protection can cover you if
  4. As a buyer your Sale Item has not arrived, or if what you received is significantly not as described or faulty.
  5. As a seller you are sent an unauthorized payment, or a buyer claims that they did not receive their Sale Item, you can report the issue to us within 14 days and we will reply to you with instructions of how to proceed
  6. In order to be eligible for Its all Irish Buyer or Seller protection you must purchase the Sale Item using It’s all Irish payment gateway via Stripe and report the transaction issue with 14 days from the date of receiving your product/s. Buyer or Seller protection applies only if these conditions are met.
  7. To qualify for It’s all Irish Seller protection, you must be able to prove that
  8. You dispatched the order to the address provided on the It’s all Irish receipt within 7 days of the order (or any time frame set out in the description of the Sale Item in question is different)
  9. You responded to any It’s all Irish emails relating to such Sale Item within the requested period
  10. The Sale Item materially and significantly conformed to the description thereof in your shop. As a seller non-material goods, prohibited items and meet in person transactions are not covered by It’s all Irish Seller protection.
  11. If you decide to appeal any decision made by the vendor, then please contact us at dispute@itsallirish.ie
  12. Most items can be refunded once the criteria is met. However, there are some exclusions to this. Some examples may include:
  13. A) Perishable goods such as foods
  14. B) Goods that are personalised or custom-made, for example, a t-shirt with your name on it, jewellery that has been engraved, or furniture built to your specification
  15. C) Items that have been unsealed and cannot be returned for health protection or hygiene reasons, this could apply to, for example, underwear, cosmetics, earrings.
  16. It is the responsibility of the customer to pay the return shipping on the product. It is advised that tracked shipping is used so that there is proof of shipping.

 

Shipping/ Delivery

  1. The seller is responsible for the shipment of the Sales Item to the Buyer.
  2. It is the vendors responsibility to set up their delivery details. It is important that you represent accurate shipping times, methods of shipping and tracking order numbers where applicable. It is also required that you upload your own shipping policy to your store when registering.
  3. It’s all Irish will not be responsible for any local custom charges, import taxes or duties or any other similar charge(s) incurred through the carriage and/ or delivery of shipments. If any such charges become due to It’s all Irish by any competent authority the seller agrees to reimburse It’s all Irish fully in respect of the same within 7 days of our demand.

 

Change to Service

We are constantly updating and improving our Service and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect the changing technologies, tastes, behaviours and the way people use the internet and our Service. In order to do this we may need to update, reset, stop offering and/ or supporting a particular part of the Service, or feature relating to the Service. Any changes to the service could involve Service Elements being deleted or reset.

You agree that a key characteristic of our Service is that changes to the Service will take place over time and this is an important basis on which we grant you access to the Service. Your continued use of the Service will show that you have accepted any changes to the service. We will inform our Users of any major changes made to the Service and will prompt our latest Terms of Service when you login for you to accept the revised Terms of Service. You are always free to discontinue using the Service or deactivate your account by contacting us at Support@itsallirish.ie from the email addressed to your account.

 

 

Documents that apply to Our Relationship

The current version of the Terms of Service contains the only Terms and Conditions that apply our relationship with you. We intend to rely on these Terms of Service as setting out the written terms of our agreement with you for the provision of the service. If part of the Terms of Service cannot be enforced the remainder of the Terms of Service will still apply to our relationship. If you do not comply with these Terms of Service and we do not take action immediately, this does not mean we have given up any right we have and we may still take action in the future.

Law and General Provisions

As we are based in Ireland, Irish law will apply to all dispute and the interpretation of these Terms of Service. Any dispute arising from, or related to, contracts shall be subject to the exclusive jurisdiction of the courts of Ireland.
